Defective and Dangerous Medications

We live in a very fortunate time when medications can save lives, extend life, and improve quality of life for people who, just decades ago, had few or no options. But it is also a very dangerous time because the booming pharmaceutical industry often puts profits before lives, selling harmful and deadly medications and medical products which have not been adequately tested or worse, knowingly hiding the risks and side effects.

Pharmaceutical Injuries

Drug injuries can range in severity from a mild annoyance to deadly. They may or may not even seem to be related to the purpose of the drug or the condition it is used to treat. They can be caused by prescription and over-the-counter (OTC) drugs.

Pharmaceutical injuries also include injuries caused by defective medical devices and products other than medications.

Injuries caused by defective drugs and medical products fall under a category of law called product liability. Some pharmaceutical injuries fall under medical malpractice. Under certain circumstances a drug injury can result from a combination of medical malpractice and product liability.

Understanding Drug Recalls

Defective and dangerous drugs are not always recalled, and even when there is a “recall” it does not always mean that the drug is withdrawn from the market. More often, the U.S. Food and Drug Administration (FDA) requires changes in the warning label to indicate formerly undisclosed dangers.

However, a drug does not have to be recalled in order for you to have a case. You have the right to make an informed choice before using a dangerous medication, and weigh the risks and benefits for yourself. When a drug or device maker fails to warn doctors and consumers of the risks its products pose that, in itself, is considered to be a defect, and grounds for a product liability suit.
